Terms of service

Article 1 (Purpose)

  1. This Terms of Service shall prescribe the rights, duties, and responsibilities of users and Young Poong Co., Ltd. (hereinafter referred to as “Company”) with respect to the use of the Internet services (hereinafter referred to as “Service”) offered by the Company on its website (www.ypzinc.co.kr).
  2. Users shall refer to those who access the website and receive the service offered by the Company.
  3. The rights, duties, and responsibilities of users and the Company not specified in these Terms of Service shall be governed by relevant laws of the Republic of Korea, such as the Telecommunications Business Act and applicable commercial customs. If a notice is to be sent to a user, it may be substituted by posting it on the website's bulletin board.

Article 2 (Protection of Personal Information of a User)

The Company shall endeavor to protect users’ personal information including users’ registration information as prescribed by relevant laws. Matters related to the protection of personal information of a user shall comply with relevant laws and the Personal Information Processing Guideline determined by the Company.

Article 3 (Duties of the Company)

  1. The Company shall not engage in any act prohibited by relevant laws or these Terms or Service, or any act contrary to public order and good morals and shall make efforts to provide the service continuously and reliably in accordance with these Terms of Service.
  2. The Company shall establish security systems to protect users’ personal information so users can use the Internet service safely.
  3. The Company shall not transmit unwanted advertising e-mails for profit.

Article 4 (Duties of Users)

  1. No user shall engage in any of the following acts:
    • Posting false information;
    • Changing information posted by the Company;
    • Infringing on the moral rights or intellectual property rights of the Company or a third party, or interfering with the business thereof;
    • Sending junk mail, spam, chain letters, emails recommending participation in a pyramid scheme, or emails containing obscene or violent content (including messages, images, or audio), or disclosing or posting any other information contrary to public order and good morals;
    • Transmitting or posting information (e.g., computer program) of which transmission or posting is prohibited by relevant laws;
    • Uploading posts, or sending e-mails while pretending to be, or impersonating an employee of the Company or an administrator of the website’s service, or misusing another person’s name or identity;
    • Uploading or transmitting, via email or other means, any material containing software viruses or other computer code, files, or programs designed to disrupt, destroy, or interfere with the normal operation of computer software, hardware, or telecommunications equipment;
    • Harassing other users, including but not limited to stalking;
    • Collecting, storing, or disclosing personal information of other users without consent;
    • Performing any act for profit using the service of the website by uploading advertising or promotional content directed at numerous unspecified individuals, sending spam emails, or using other similar methods.
    • Any other acts breaching the Terms of Service prescribing the service offered by the Company or violating other regulations on the use of the service.
  2. Users shall be responsible for indemnifying damage sustained by the Company or other users if such damage results from an act attributable to the user.

Article 5 (Deletion of a Published Post)

If a user's published post falls under any of the following, the Company may delete the post without prior notice and may restrict, suspend or revoke the user’s qualifications.

  1. Content which slanders other users, or a third party, or damages the reputation thereof by defamatory or malicious representations.
  2. Content with information, sentences, symbols, etc., going against public order and good morals;
  3. Content deemed related to criminal acts:
  4. Content infringing on other users or a third party’s copyrights, or other rights;
  5. Other content deemed to violate relevant laws.

Article 6 (Responsibility for a Post and Policy thereof)

A user who uploads a post to a bulletin board shall have the copyrights thereof. Any information or opinion expressed in the post is solely that of the user and does not reflect the stance of the Company.

If any problem arises out of or in connection with a post uploaded by a user on a bulletin board, the user shall bear full responsibility.

The Company shall bear no responsibility for content uploaded or published by a user on a bulletin board or transmitted by such user using the service. The Company may delete a post that is eligible for removal after providing prior notice. However, if a post is deemed to include clearly illegal content, it may be deleted without notice.

In cases where a post uploaded by a user infringes on another person’s copyright, program copyright, or other intellectual property rights, and the user fails to take responsibility under the Civil Act and/or the Criminal Act, and consequently, the Company receives complaints such as a third party’s claim for damages, the user shall bear full responsibility for indemnifying any damages.

  1. When all content uploaded by a user within the scope of the service is deemed violating the bulletin board operation rules, the Company may delete them with or without prior notice to the user, and in addition, may impose reasonable sanctions against the user according to the seriousness thereof.
  2. The Company may, at its sole discretion, create or delete additional categories or bulletin boards as needed. In addition, the Company may determine or change the upload period or storage period for materials stored on the bulletin boards.
  3. The Company may edit or move a post uploaded by a user, if necessary, without prior notice. Additionally, the Company may delete a user’s post if the user terminates the Terms of Service, or the Terms of Service are terminated for reasonable grounds.

Article 7 (Post Deletion Standards and Sanctions)

The Rules of the Korea Internet Safety Commission shall be basic principles, and any posts with content falling under any of the following shall be prohibited for registration.

  1. Any posts with the following content violating current laws, going against public order, or undermining traditional customs:
    • Content to undermine state ideology and the existence of the state and aim to perform an anti-state act;
    • Content to infringe on the rights of other person or organization, or damage the reputation thereof;
    • Content containing false information that may cause social confusion;
    • Content to invade the privacy of a person;
    • Content that is violent and shows no regard for human life, or content that praises or encourages criminal acts or delinquent behavior;
    • Content depicting specific methods of a criminal act that may cause a copycat crime;
    • Content and/or information that create disgust to the viewers thereof;
    • Content that excessively stimulates sexual desires, or creates disgust;
    • Content detailing unethical, inappropriate sexual conduct such as extramarital relationships or incest, or that is presented in a way to arouse interest.
    • Content that specifically and realistically depict sexual crimes such as sexual violence, rape, and gang rape, or beautify them;
    • Content that commercializes sex or excessively exposes or comments on specific body parts;
    • Content which insults another person’s character using vulgar expressions such as swearing or verbal violence, or causes feelings of displeasure or disgust;
    • Content to encourage emotional conflicts between specific religions;
    • Content that promotes superstition or encourages unscientific attitudes toward life.
  2. Any posts with improper content:
    • Spam content, such as profanity, chain letters, or similar messages;
    • Cases where the personal information of a specific individual is disclosed, and such disclosure is likely to result in harm;
    • Cases where unfounded content is uploaded, likely resulting in an invasion of a public figure’s privacy and/or damage to their reputation;
    • Cases where the content of a post goes against the nature of the bulletin board, or the same post appears on several bulletin boards;
    • Posts with extremely sloppy or meaningless content;
    • Posts whose content cannot be confirmed on screen due to bugs;
    • Posts that cause confusion on the bulletin board by creating controversy unrelated to the intended subject of the category;
    • Cases where a post previously deleted by an administrator is quoted in its entirety;
    • Content seeking or arranging partners for sexual activities, including prostitution, cybersex, or explicit sexual conversations;
    • Content on guiding, or arranging a place where obscene information, or adult entertainment venue(s) offering illicit sexual services is available;
    • Posts to emotionally criticize a specific user or individual, and induce disputes;
    • Posts that excessively promote medical services, medical devices, medications, or dietary supplements in a way that may encourage misuse or overuse;
    • Posts with quotations from an unverified source (so-called shared writing from somewhere); or content with information or an opinion for which the uploader cannot take responsibility;
    • Any acts to register or distribute computer virus-infected materials capable of causing confusion such as malfunction of telecommunications equipment, or destruction of information, etc.
  3. Any posts violating copyright;
    • Content that guides registration, uploading, and distribution of commercial programs;
    • Content explaining the distribution of software whose authenticity cannot be confirmed, or the distribution of various copyrighted works;
    • Content infringing on copyright, trademark rights, design rights, or other intellectual property rights of others, without obtaining proper authorization;
  4. Any posts related to online sales, purchases, or money-making of which uploading is prohibited;
    • Posts related to websites to make money;
    • Content directly or indirectly promoting a specific website or product;
    • Content related to copying or selling (including a backup CD) of illegal games, software, albums, or videos;
    • Content promoting obscene or violent materials to sell them;
    • Videos and copyrighted materials violating traditional customs and encouraging a speculative spirit;
  5. Others
    • Posts that interfere with the Company’s normal management activities and services, and causing substantial disruption and harm to the Company profits;
    • Posts which are deemed likely to cause damage or loss to users.

The Company may, at its sole discretion, delete posts or content that fall under any of the above categories without prior notice. Additionally, the Company may warn or suspend the concerned user from using the service if violations are repeated or if the resulting damages are deemed severe.

Article 8 (Reversion of Copyright and the Restriction of Use)

  1. Assets related to the website, including copyrights, trademark rights, technology, text, graphics, audio, video, downloads, links, and source codes (hereinafter referred to as “Website Service”), are owned by the Company, which holds all rights to the service. The information provided in all forms is made available to users for their convenience. However, the Company informs you that "You are not granted the right to use this information for commercial purposes." No user shall use the service of the website for purposes other than personal use.
  2. Users shall not use information obtained while using the website for profit without prior approval of the Company by copying, transferring, publishing, distributing, or broadcasting such information, or any other means, or shall not allow a third party to use such information

Article 9 (Exemption from Responsibility)

  1. The Company shall not be held responsible for a user's failure to achieve the expected profit from using the service, or for any losses incurred by the user from materials obtained while using the service.
  2. The Company informs you hereunder that the information or materials on the website do not satisfy the requirements of institutions related to securities transactions. In that sense, you are advised not to make investment decisions in reference to such information or materials. In connection therewith, the Company explicitly informs you that the Comapny does not guarantee accuracy or reliability of such information or materials as commercial or financial information.
  3. The Company shall offer various links to the website in accordance with its internal guidelines. is provided to allow users to obtain information for their convenience. However, the Company bears no legal responsibility for such linked websites and does not guarantee their reliability. Users are advised to assess each linked website and use it efficiently at their own discretion.
  4. Users shall be individually responsible for the reliability and accuracy of the information, materials, facts, etc., uploaded by them. The Company shall bear no liability for any losses incurred by the user or a third party resulting from inaccuracies or falsehoods in such content.
  5. The Company shall not be liable for any losses to a user or a third party resulting from the user's intentional acts or negligence in connection with the use of the service.

Article 10 (Amendment of the Terms of Service)

  1. The Company may amend these Terms of Service, provided that such amendments do not violate relevant laws such as the Act on the Regulation of Terms and Conditions, the Framework Act on Electronic Documents and Transactions, the Digital Signature Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection.
  2. In amending these Terms of Service, the Company specify and publicly announce the reason for amendment and effective date alongside the current Terms of Service on the initial screen of the website for seven (7) days until the date before the effective date.
  3. Users have the right to reject the amended Terms of Service. A user can express his/her refusal within fifteen (15) days following the public announcement of the amended Terms of Service. If a user rejects, the Company may terminate these Terms of Service (a contract?) with the user. Unless a user expresses his/her intention to refuse within the fifteen-day period mentioned above, he/she will be deemed to have agreed with these Terms of Service.

Article 11 (Jurisdiction)

If any dispute arises out of and in connection with the Terms of Service between the Company and a user, the laws of the Republic of Korea shall apply. Any lawsuit arising from such dispute shall be filed with the competent court under the Civil Act of the Republic of Korea.

Addendum

These Terms of Service shall take effect on September 8, 2011.
